1. GENERAL CONDITIONS

These general conditions of sale are agreed between Iodis & Jewelry Unipessoal Lda, headquartered at Rua Armando Villar 485 Cobre, 2750-777 Cascais, registered at the Commercial Registry Office of Lisbon, with the Registration and Identification number of Legal Person 516183192, with a share capital of €1,000.00, hereinafter referred to as "Freemind Jewelry" and persons who make purchases through the Freemind Jewelry Website - www.freemind.jewelry  hereinafter referred to by "User", and the User must always be a non-merchant natural person.

Purchases made through this website are governed only by these general conditions of sale, excluding any conditions previously available on the website or by prior express and written agreement.

Iodis & Jewelry Unipessoal Lda may from time to time modify provisions of its general conditions, so the User must re-read them each time they visit the “Freemind Jewelry” website.

The present general conditions of sale are intended to provide and define the necessary information for the user and regulate all the necessary steps for placing the order.


2. Freemind Jewelry  - FREEMIND FAMILY CLUB

By becoming a member of the FREEMIND FAMILY CLUB and receiving newsletters from Iodis & Jewelry Unipessoal Lda. You agree to be contacted using any contact information you provide to us. You can ask to cancel at any time. Additional information is available in the Privacy Policy. You can also choose which newsletters you want to subscribe to:

 - Launch of limited jewelry collections
 - Discounts and Promotions
 - Events (parties, exhibitions, promotions at points of sale)
 - Brand contests

When you visit the Sale/Promotions page after registration, you will find special offers and discounts on some “Freemind” jewels, available only to registered members of the FREEMIND FAMILY CLUB

2.1. “FREEMIND FAMILY CLUB Terms and Conditions”
 The conditions for joining the FREEMIND FAMILY CLUB are very simple. To start enjoying all the privileges of the club, you need to:
 - Register on our FREEMIND FAMILY CLUB
 - Buy your first jewel through our online store www.freemind.jewelry

2.2. Subscribe to the club's newsletters, choosing the type of news that most interests you.
 If you decide to unsubscribe, you will remain our favorite loyal customer and you will be able to quickly make all purchases using your account and the points accumulated in it.
 But - some of the club's special offers and limited jewelry collections will not be available to you. You will no longer be the first to hear about all new products and exclusive offers.
 

IMPORTANT: after purchasing any “Freemind” jewelry - you will only be a registered User, you will be able to receive newsletters, but you will not have access to limited collections and some club promotions!

 What are the conditions of this program?

When buying jewelry on our website www.freemind.jewelry worth:
 – 500 to 3000 euros - get 5% off on your next purchase.
 – 3000 to 5000 euros - get 10% off on your next purchase.
 – 5000 euros and more - get a 5% discount for a regular customer on all subsequent purchases through your personal account.

The maximum discount on jewelry in the loyalty program is 10%. If you already have a regular customer discount - 5%, you can get a 10% discount again on your next purchase by placing a new order worth 500 euros.

Above all, we value honesty and transparency, so that we can build a solid and lasting relationship with our customers, based on trust and mutual benefit. 4. ORDER AT WWW.FREEMIND.JEWELRY

4.1. To place the order, the User must add items to the shopping cart, edit the quantity of the items and complete the purchase using the “Finish order” option.

4.2. In order to place your order, the User must:
     a) Login or register on the Freemind Jewelry website or choose "Guest Checkout";
     b) Complete the requested information, name delivery and billing address, delivery and payment methods.

4.3. The completion of the order by the user represents full and complete acceptance of the prices and description of the products available for sale as well as the general conditions.

4.4. Jewelry Customization – “Freemind Jewelry” has a jewelry customization service, tailored to the consumer's taste, for that, just get in touch using the form available on the freemind.jewelry website. The personalization of a piece can also be an engraving: a monogram, a date or a message. The creation of the piece, its shipping and the price will depend on the complexity, the chosen materials and their availability in stock.

4.5. “Freemind Jewelry” respects the deadlines of an order as long as there is stock availability. In the event that there is no stock availability, “Freemind Jewelry” will contact the customer by email or by telephone, in order to inform the new delivery date of the product. If the customer does not agree with the delivery time, he may choose to buy another item or refund the amount paid.

4.6. Pre-order:

If you really like a piece of jewelry from Freemind Jewelry but it's not in stock, you can place a pre-order.

The shipment of pre-ordered items takes between 4 to 8 weeks due to the production cycle of each piece of jewelry, which takes approximately 3-4 weeks. Afterward, we send the finished jewelry to the Assay Office of Portugal and only then ship your order.

We are allowing a little extra time for the production of items that are not in stock to avoid unforeseen situations. However, we will do our utmost to fulfill your order as quickly as possible!

If you have selected multiple items that are in stock but have a pre-order item in your cart, the entire order will be shipped according to the pre-order production timeline! Therefore, if it's important for you to receive the in-stock items more quickly, please place two separate orders!

Pre-orders are only possible with 100% payment for the selected item!

4.7 Electronic Gift Certificate

Your electronic gift certificate will be sent to your specified email address within 24 hours after completing the order and will become valid 24 hours after payment confirmation. If payment is not received within this time frame, Freemind Jewelry reserves the right to cancel the order.

4.8. Order Refusal

Refusing a customer when purchasing jewelry from an online store can occur in the following situations:

  • Lack of Identity Confirmation: If the customer does not provide sufficient information or requested documents to confirm their identity in accordance with the privacy policy, the store may refuse the sale.

  • Insufficient Age: If the customer has not reached the legal age for purchasing jewelry in accordance with local laws, the sale may be refused.

  • Unsatisfactory Source of Funds Verification: If the customer cannot explain or confirm the source of funds used to purchase expensive jewelry items, it may raise suspicion and lead to refusal.

  • Suspicious Activities: If the customer exhibits suspicious behavior, such as making multiple large orders from different accounts or requesting abnormal payment methods, the store may refuse.

  • Non-Payment: If the customer does not pay for the order in accordance with the terms provided by the store, the seller may refuse the sale or cancel the order.

  • Geographic Area Restrictions: If the jewelry store restricts its sales to specific geographic areas due to customs or legislative constraints, customers from such regions may be refused.

 

5. DELIVERY

5.1. The delivery of orders is carried out through different carriers contracted by “Freemind Jewelry”. You can check the cost and delivery time here.
Freemind Jewelry undertakes to make every effort to ensure that the delivery takes place during the stipulated period.

5.2. Products marked as having limited stock and/or products with engraving may have an additional delivery time than that generally announced on the website.

5.3.In case of unavailability of the ordered product, “Freemind Jewelry” will inform the customer and refund the amount that has been paid, within a maximum period of 15 days from the knowledge of the unavailability.

5.4. “Freemind Jewelry” cannot be held responsible, in any way, for any damages, direct or indirect, arising from delays in deliveries or the unavailability of the ordered item.

5.5. To track an order in progress, the user can do so through their personal account or follow the order through this page.
If you are not present at the indicated address, the user will receive an SMS with the indication that his order is available for collection at the post office to be determined and until when he can collect it. At the time of withdrawal, simply present the SMS.

5.6. Custom made items may have additional delivery time than what is normally indicated on the website.


6. PAYMENT 

6.1. “Freemind Jewelry” allows the user the following payment methods:
    a) Credit Card (Visa and Mastercard, Eurocard and American Express);
    b) MBWay;
    c) Multibanco;
    d) Paypal;
 

6.2. “Freemind Jewelry” will make every effort to guarantee maximum confidentiality and security for data transmitted over the internet.


7. PRICES

7.1. Prices are shown in Euros, taking into account the VAT tax in force on the date of payment of the order.

7.2 To the shown price, is added the delivery fee which varies according to the destination address.


8. RETURNS AND EXCHANGES

8.1. Any order contract made on the “Freemind Jewelry” website can be freely resolved under the terms of article 6 of Decree-Law no. 143/2001, of April 26, within a maximum period of 14 days from the date of receipt of the order by the consumer.

8.2. Exchanges are always accepted when the piece is in perfect condition, whithout sings of use, with it’s original packaging and security label, not more than 14 days after the date of purchase.
In the case of an exchange, the user can send it to the address Rua Armando Villar 485 Cobre, 2750-777 Cascais. The article must always be accompanied by the invoice. Exchanges are only accepted for items in the same state in which they were sent. Upon receipt of your items, the “Freemind Jewelry” team will carry out a quality control process, validating the framework for your exchange.

8.3. The user, if he wishes to return, must access the order history in his personal account and in the details of the same, click on "return".

8.4. The collection method available for returns is by shipping to the “Freemind Jewelry” address: the entire process is handled by the user with the carrier of his choice. The address is Rua Armando Villar 485 Cobre, 2750-777 Cascais.
Returns are only accepted if the piece is in perfect condition, without sings of use, with it’s original packaging and security label, not more than 14 after the date of purchase. Items to be returned must be delivered with the respective certificate of authenticity. 
Once the returned products have been checked at our Centre, you will receive a confirmation email indicating that the amount will be paid using the same payment method you used for the purchase. We remind you that the period in which the refund will be available in your account will depend on the bank.

8.5. The refund will be made in full using the same payment method used to purchase the products and within 14 calendar days of receiving the order.

8.6 If you receive an incorrect or defective item, please contact our team directly by accessing the “Contact Us” menu in the Online Store. In this way, we will give priority and special attention to the return and refund or exchange process.

8.7 Exchange or return of personalised products is not accepted.
 

9. AFTER-SALES AND WARRANTY SERVICES

All items sold by “Freemind Jewelry” until December 31, 2021 are covered by the 2-Year Manufacturer Warranty, guaranteed by the respective brands. After this date, the warranty period for the products is 3 years. After the warranty expires, Freemind Jewelry also provides Technical Assistance. In the case of defective or faulty products, go to the Freemind Jewelry store, taking the item and the respective invoice with you. Whenever the repair involves costs for the customer, it will only be started after the customer accepts the quote.
Warranty term: Three years from date of purchase. This warranty covers manufacturing defects. If you want to replace it under warranty, use our Contact Us form.
In the message you must indicate your name, address, order number and detailed description of the problem.
If “Freemind Jewelry” does not find any defect described above, the article will be returned to the customer.

Please note that repairs/replacements will be charged in the following cases, even if it is within the warranty period:
 – Failure or damage caused by improper use (knocks, dents, crushing, etc.)
 – Failure or damage caused by unwarranted modifications or repairs
 – Failure or damage caused by fire or water, or a natural disaster such as an earthquake
 – Aesthetic changes caused by normal use and wear and tear.
 – If the store and date of purchase are not indicated in the guarantee, or if this information has changed
 – If the warranty card or invoice is not shipped with the part.

The guarantee ensures that the User/Customer shall receive free replacements in accordance with the terms set out in the Terms and Conditions, within the specified term and shall not restrict any legal rights of the Customer.


10. NEWSLETTER Freemind Jewelry 

10.1. The “Freemind Jewelry” Newsletter integrates emails with offers, promotions and other information, sent to the user's email box provided to “Freemind Jewelry” upon user registration. The user can subscribe to the Newsletter, being automatically registered from the moment he places his first order online. For more information you can check our “Freemind FamilyClub” .

10.2. To modify your personal data, the user must go to his personal area.


11. INTELLECTUAL PROPERTY

The “Freemind Jewelry” website and the content available therein is protected by copyright and industrial property laws and may not be copied, reproduced or disseminated, either in whole or in part. It is prohibited, namely, to copy or retransmit any text, logo, graphic, sound or image from the “Freemind Jewelry” website unless this is expressly permitted by “Freemind Jewelry”.
The printing and collection of information contained on this site for personal use is permitted.


12. LITIGATION AND LIABILITY

12.1. “Freemind Jewelry” is not responsible for inconveniences or damage caused to the user by using the Internet network, such as: service interruption, external intrusion, anomalies caused by computer viruses or any other case of force majeure.

12.2. The law applicable to any contractual relationship established through the “Freemind Jewelry” website is Portuguese law.

12.3. In order to resolve any and all conflicts arising from any contract entered into under these general conditions of sale, the District Court of Lisbon will be competent, with express waiver of any other.
